Terms of Service

These Terms of Service ("Terms") govern access to and use of the BookedOps website and the BookedOps AI receptionist service for home-service businesses (together, the "Service"), provided by BookedOps LLC ("BookedOps", "we", "us"). By using the website or the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who these Terms cover

These Terms apply to home-service businesses that sign up for the Service ("Business Customers") and to the staff, on-call technicians, and owners a Business Customer designates as contacts within the Service ("Authorized Contacts"). See our Privacy Policy for how we handle personal information, including information about a Business Customer's own leads and callers.

2. The Service

BookedOps answers inbound phone calls, texts, and chats on behalf of a Business Customer using an AI voice/text agent. It runs a structured intake, classifies urgency, escalates likely emergencies to a human Authorized Contact by SMS and phone call, and delivers a summary and transcript of each interaction to the Business Customer. Callers are told at the start of a call that they are speaking with an automated assistant.

4. SMS / text-messaging program terms

Program name: BookedOps Operational Alerts. Program description: transactional text messages that notify a Business Customer's Authorized Contacts about that business's own inbound calls — new-lead notices, urgent escalation alerts, and fallback notices when a call could not be processed automatically. BookedOps does not send marketing or promotional text messages under this program.

5. How consent to receive text alerts is collected

When a Business Customer signs up, the business owner completes a web onboarding form and signs a Master Service Agreement (MSA). On that form, the owner enters the mobile number of each Authorized Contact (on-call technician, office staff, and/or the owner) who will receive operational text alerts, and confirms — as a required, separately labeled checkbox next to each number — that the named person has agreed to receive text alerts about that business's inbound calls, including the program name, expected frequency, "message and data rates may apply," and how to reply STOP or HELP. The MSA additionally requires the Business Customer to keep this list current and to obtain a fresh confirmation before adding a new contact. No consumer marketing consent is collected or implied by this process.

6. Fees

Pricing is provided directly to Business Customers during onboarding. Fees, billing cadence, and cancellation terms are set out in the order form or MSA a Business Customer signs and are incorporated into these Terms by reference.

7. Acceptable use

You may not use the Service to send unlawful, harassing, or deceptive communications, to record calls in violation of applicable consent laws, or to interfere with or reverse-engineer the Service.

8. Disclaimers and limitation of liability

The Service is provided "as is." BookedOps is not liable for missed, delayed, or misclassified calls, texts, or escalations to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Termination

Either party may terminate the Service as set out in the applicable order form or MSA. We may suspend or terminate access for a material breach of these Terms.

10. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date and, where appropriate, additional notice.
